COMMUNIQUE on LOCAL GOVERNMENT AUTONOMY AND THE PRESERVATION OF DEMOCRATIC INSTITUTIONS IN NIGERIA Preamble The Alumni Association of the Department of Political Science, University of Ibadan, convened a discourse on the contentious issue of local government autonomy in Nigeria. The discourse highlighted various perspectives on the current state and future of local government autonomy, its implications for democratic institutions, and the wellbeing of the people. This communique aggregates the diverse viewpoints shared during the discussion. Key Points of Discussion Historical Context and Legal Framework Local governments in Nigeria have historically operated under the significant influence of state governors. The 1999 Constitution structures local governments to be under state control, particularly regarding financial matters, through the State Joint Local Government Account (Section 162). Past judicial interventions, such as the 2003 Supreme Court ruling in favour of Lagos State’s Local Council Development Authority (LCDA) government creation, highlighted the complexities and tensions in the federal-state-local government relationship. Arguments for Autonomy Proponents argue that local governments should have greater financial and administrative autonomy to enhance grassroots development and ensure democratic accountability. Autonomy in funding and tenure security for elected officials are seen as critical steps towards achieving this. There is a call for constitutional amendments to grant local governments direct access to federal allocations and protect them from arbitrary dissolution by state governments. Challenges and Concerns Opponents point out that no federal system in the world grants complete independence to local governments. They argue that local governments should remain under state supervision to maintain the integrity of the federal system. Concerns about local government inefficiency and corruption are raised, with some noting that greater autonomy might exacerbate these issues without proper oversight mechanisms. Judicial and Constitutional Considerations The 2024 Supreme Court’s ruling on local government financial autonomy sparked debates. Some view it as a positive step towards reducing state governor control, while others see it as inconsistent with the constitutional provisions that mandate state oversight. Suggestions were made for further legislative action to clarify the roles and powers of local governments, including criminalizing the misappropriation of funds and ensuring regular democratic elections at the local level. Practical Implications and Future Directions The practical impact of the Supreme Court ruling remains to be seen, particularly regarding the implementation of financial autonomy and the potential resistance from state governments. Emphasis was placed on the need for a holistic approach that balances autonomy with accountability. This includes revisiting constitutional provisions, enhancing local government capacity, and fostering a culture of transparency and good governance at the grassroots level. Conclusion The Alumni Association of the Department of Political Science, UI, recognizes the critical role of local governments in Nigeria’s democratic framework. While there are divergent views on the extent and nature of local government autonomy, there is a shared commitment to ensuring that local governments can effectively contribute to the development and wellbeing of the people. We call for continued dialogue, legislative action, and institutional reforms to achieve a sustainable and functional local government system in Nigeria. Recommendations 1. Constitutional Amendments: Constitutional amendment is strongly advocated to grant local governments a direct access to federal allocations and secure their tenure. 2. Strengthening Oversight: Enactment of measures to enhance oversight and accountability at the local government level. Civil society groups have role to play in this endeavour. 3. Judicial Clarification: Further clarification and guidance is imperative from the judiciary on the constitutional roles and powers of local governments. 4. Capacity Building: Invest in building the capacity of local governments to deliver services effectively and transparently. 5. Public Awareness: Increase public awareness and engagement on the importance of local government autonomy and its implications for democracy and development.
