Justice Adeniyi Ademola of the Federal High Court ,Abuja has struck out the two count charge against terror suspect ,Aminu Ogwuche for want of diligent prosecution by the Police.
According to Justice Ademola: “This criminal charge is hereby struck out for want of diligent prosecution by the complainant, Inspector General of Police and his prosecutor.”
Justice Ademola also granted the oral application sought by Ogwuche’s counsel, Mr. Ahmed Raji (SAN) for family members to have access to the alleged bomber.
The court ruled that that three lawyers from Ahmed Raji’s chambers and two of Ogwuche’s family members be allowed access to the suspect who is being by the SSS.
On the heels of the no objection submission by the SSS counsel, Clifford Osagie and the AGF’s counsel Mr. Taiwo Abidogun, the justice ordered : “Three lawyers from the complainant’s counsel as well as the complainant’s wife and another family member be given access to the applicant. Applicant be given medical care in the respondent’s custody and referred to the National Hospital, Abuja if need be”.
Ogwuche has however not been acquitted.It is believed the SSS is still drafting the charges against Ogwuche.He is held on suspicion of being one of the masterminds of the Nyanya bomb blast in Abuja.
He had fled the country to Sudan but was apprehended by Interpol and returned to NigeriaMr Ogwuche is also in court seeking to enforce his fundamental human rights.
He has been in detention since July.His lawyers say the state should either take him to court or free him instead of being held ad infinitum
