The Independent National Electoral Commission,INEC has said it will await the decision of the Appeal filed by Senator Dino Melaye on his recall process.
This was disclosed in a statement on Tuesday by Mr Solomon Soyebi, INEC National Commissioner and Chairman, Information and Voter Education Committee said
A court had ruled that the commission should personally serve Melaye with the documents.
Giving the difficulty in carrying out this, Soyebi noted that “The Commission approached the court for substituted service but was directed to make another attempt to serve the senator.
“When this failed again, the commission returned to the court to pursue the request for substituted service but the court declined jurisdiction as the appeal by the senator had been entered at the Court of Appeal.”
The statement said Melaye’s refusal to accept service of the petition, hindered its ability to continue with the recall process .
Soyebi asserted that service of document is a necessary condition before the commission can proceed with the process
According to him, “INEC has therefore decided that in line with its usual practice and in deference to the rule of law, it will await the outcome of the decision of the Appeal filed by the Senator.”
