The National Industrial Court, Abuja, on Monday, fixed Jan. 30, to rule on whether to recall a claimant, Ayodeji Omoni , to reappear to testify in a case of alleged wrongful termination of appointment suit.
NAN reports that Omoni was employed by Ecobank Plc ( then Oceanic Bank),-in 2002 and rose to the position of a manager in 2013 when his employment was allegedly terminated wrongfully.
Justice Rakiya Haastrup, fixed the date, after Ecobank Plc, through its counsel, Afam Osigwe, told the court that he filed an application seeking for an order of the court to recall the claimant.
Afam also sought in his application, an order of court from fore-closing him from cross-examining the claimant amongst others.
He said the reason for his application, was to enable him to represent the defendant properly.
But in his objection, Mr Friday Abu, counsel to the claimant told the court that the matter was slated for adoption of final written addresses.
Abu argued his client, who is the chief witness in the suit is resident in Canada, he therefore urged the court to order the defendant to pay for the flight ticket of the claimant to and fro Canada if the court will grant the defendant’s counsel application.
Also in his counter objections, Mr Afam, told the court that there was no evidence before the court to prove that the witness is a resident in Canada as there are no documents to back up the claim of the claimant’s counsel.
The News Agency of Nigeria ( NAN), reports that Omoni who is challenging the termination of his employment is seeking for a declaration that his employment with the defendant is valid and still subsisting.
He is also seeking for an order of court for payment of his salary, benefit and entitlement from 2013 when his employment was terminated till date. (NAN)
