An FCT High Court, Kubwa on Monday ordered two contractors and their company to open their defence in a criminal trial filed by the the Economic and Financial Crimes Commission (EFCC).
The suspects are Abdulrahaman Tinau, Auwalu Haruna and Greenfields Projects International Limited.
They were docked by the EFCC on fours counts bordering on issuance of dud cheque and fraud which they pleaded not guilty to.
Justice Bello Kawu, who dismissed the “no case submission” filed by the defence counsel, Saidu Abimbola, adjourned the matter until Jan. 15 for defence.
Abimbola had earlier filed a no case submission dated Feb. 26.
Kawu held that he was as satisfied that the EFCC had established a prima- facie case against them and they should proceed with their defence.
The EFCC prosecuting counsel, Babashani Umar in response filed a reply dated April 18, adopted same with written addresses and urged the court to dismiss the no case submission.
The defendants had allegedly issued a First City Monument Bank ( FCMB) cheque of N9,500,000 and another of N4,132,500 in favour of one Aiyelabola Global Service Ltd sometime in 2013.
The cheque was however dishonoured on grounds of insufficient funds on presentation at the said bank.
The defendants had allegedly obtained Iron rods worth N15,500,000 from Aiyelabola Global Ltd under the guise of having a Local Purchase Order for an INEC contract which was false.
The offences contravened Section 97 of the Penal Code, Section 1(1) of the dishonoured Cheques Act and Section 1 (1) of the Advance Fee Fraud and Other Related Offence Act. (NAN).
