An All Progressive Congress (APC) governorship aspirant in the 2015 general elections in Sokoto state, Barrister Aliyu Abubakar Sanyinna has sued the Governor and Attorney General of Sokoto state over 36 plots of farmland.
Sanyinna contested in the APC primaries along with Sen. Umar Dahiru Tambuwal against Governor Aminu Tambuwal. Sanyinna is also a co-Plaintiff in Sen. Tambuwal’s case against Aminu Tambuwal at Federal High Court, Abuja.
The land, which is situated at Farfaru Area and covered by a Certificate of Occupancy No. SS.1126 is alleged to be taken over by government for the purpose of motor park.
In the substantive suit No. SS/24/2017 filed at the Sokoto State High Court before Justice Bello Duwale, Sanyinna seeks Court’s declaration that Sokoto government’s failure to serve notice of intention to revoke the C of O over the said land is a violation of the provisions of the 1978 Land Use Act.
It is “an abuse of powers made in flagrant disregard of the provisions of the Land Use Act, 1978,” the summons reads in parts.
Describing as ultra vires the purported intended revocation of the C of O without payment of adequate compensation, Sanyinna also avers that the state government’s invitation of the plaintiff through the village head of Arkilla is not possible valid notice to the plaintiff as envisaged by the Land Use Act 1978.
Meanwhile, a motion with No. SS/M-73/2017 for an order of interlocutory injunction has been fixed to be heard on April 19, 2017.
According to the motion, Sanyinna seeks “an order of interlocutory injunction restraining the defendants/respondents, their servants, agents and privies from interfering and or further interfering in any way whatsoever with the plaintiffs/applicants occupation and enjoyment of the said property or ejecting or attempting to eject the plaintiff, his servants and agents from the property covered by C of O No. SS. 1126 and the adjourning farm lands pending the determination of suit No. SS/24/2017.”
