Impeachment Notice:Lawmakers to Serve Nyako,Deputy through Media, Says Clerk

As controversy continued to trail moves by some members of Adamawa state House of Assembly and other PDP chieftains in the state,the clerk of the state Assembly Mr Francis Gbensenso has confirmed that he is yet to serve Adamawa State governor Murtala H. Nyako and his deputy Barrister Bala James Ngilari the notice of the impeachment as directed by the Speaker since Wednesday 18th June 2014.
But the clerk said that the Assembly’s next line of action, to serve the two impeachment notices to the Executive is to Publish the letters in at least two national dailies which he said is equally a right alternative as advised by the Assembly’s lawyers.
The clerk explained that both the governor and his deputy have sealed off their offices since the directive was given to him.
He said that he had made several attempts to deliver the letters but all his efforts ends in futility due to the evasive disposition of the people concerned.
Investigation revealed that both Nyako and his Deputy are out of the state as the Deputy Governor was out of the country for medical treatment.
But a constitutional lawyer Barr. Sunday Wigra and Hon.Ibrahim Bappa Waziri former member of the state Assembly have contrary views on the purported plan of using media by the lawmakers to service the impeachment notice .
‘’If the house should service Nyako and his deputy impeachment notice through newspapers it will become invalid,’’ said Wigra.
According to him section 188 sub section 2 (b) of the constitution of Federal Republic of Nigeria say that the speaker of house of assembly shall, with the 7 days of the receipt of notice, cause a copy of the notice to be service on the holder of the office not through media he claim.
‘’There were flaws in whole process. Because after the sitting,there was no adoption of votes of proceedings as enshrined in rules guiding proceedings of the state Assembly,and even the impeachment notice instead (of being0to addressed to the governor and the deputy were addressed to the speaker,’’ said a former lawmaker in the state Assembly,Hon.Bappa Ibrahim Waziri.
