Court issues ‘Form 48’ to Nigeria’s Attorney General

The Federal High Court sitting in Abuja has issued notice of consequences of disobedience of court order otherwise known as Form 48 to the Honourable Attorney General of the Federation and Minister of Justice over his refusal to comply with the order of court to President Buhari to set overall limits for the amounts of consolidated debt of the Federation, state and local governments.

This was contained in a press release by Legal Officer, Kingsley Nnajiaka Esq, Centre for Social Justice.He  noted that  the court had on 20th February 2018 ordered the Honourable Attorney General of Federation and Minister of Justice to within 90 days of the judgment to   comply and executive the provision of section 42(1) of the Fiscal Responsibility Act, 2007 to wit:  to furnish the president who was the 1st Defendant in the suit with the necessary advice and information to enable him set overall limits for the amounts of consolidated debt of the Federation, state and local governments.

It will be recalled that Centre for Social Justice has earlier sued the defendants in suit no: FHC/ABJ/CS/302/2013 between Centre for Social Justice vs The President of the Federal Republic of Nigeria & 4ors challenging the indiscriminate borrowing from banks and other financial institutions at will by both the Federal and State Governments without regard to the impact on the economy and the coming generation.

Judgment was delivered by Honourable Justice G.O. Kolawole J (as he then was) on 20th February 2018 and the order has not be complied with despite assurances from A.A.  Rufai Esq who represented the Attorney General  of the Federation and President  Buhari  in court to comply with the order of the court.

If the Attorney General refuses to comply with the order of the court, the court will serve him with Form 49 and thereafter commit him to prison. The committal proceeding is now before Honourable Justice Ekwo following the elevation of Justice G.O Kolawole to the Court Appeal.
