An Ekiti Customary Court sitting in Ikole-Ekiti on Wednesday dissolved the 13-year-old marriage between a trader, Mrs Odunayo Afolabi and her husband, Olumide Omotoso, over irreconcilable differences.
The President of the Court, Mrs Yemisi Ojo, awarded custody of the three children to Afolabi for proper care and upbringing.
She ordered Omotoso to be responsible for the payment of the school fees of all the children.
The court president also ordered the petitioner to always allow the children to visit their father during the holidays.
She warned the respondent against maltreating the children whenever they visit him.
Earlier, the petitioner, Afolabi, 32, a trader , in her evidence said that she was not ”customarily married” to the respondent who is the father of all her children.
She told the court that the respondent always beats and accuses her of adultery and being possessed by evil spirits.
Afolabi prayed to the court to dissolve the marriage to enable her have peace of mind.
The mother of three children, also prayed to the court to award the custody of all her children on the grounds that the respondent always maltreat her children.
She however appealed to the court to order the respondent to pay N20,000 as monthly feeding for the children.
The respondent, Omotoso, 35, a wood operator, denies beating the petitioner.
Omotoso accused the petitioner of committing adultery with her boss.
The respondent also accused the petitioner of being possessed by evil spirits.
He also prayed to the court to award the custody of his children to him.(NAN)
