The Census Tribunal presided over by Hon. Abraham N. Yisa (Chairman), Hon. Mrs. Sylvia Shinaba, (SAN) (Member) and Prof. Mustapha Duze (Member) delivered its judgment today, the 30th day of May, 2013, in Complaint No. CTA/Delta/02/22 Between Chief Tuesday A. Onoge, Chief Isaac Iteke (J.P) (for themselves and on behalf of Indigenes of Uvwie Local Government Council, Delta State) VS. National Population Commission & Anor .
The Complainants took its case against the National Population Commission before the Honourable Tribunal on the 2nd of July, 2009, wherein the census result of Uvwie Local Government Area of Delta State as declared by the 1st Respondent was challenged.
According to the census result release by the National Population Commission, the population of Uvwie Local Government Area of Delta State is188,728, which is a figure that was not accepted by the Complainants and the entire people of Uvwie Local Government Area of Delta State.
The Complainants prayed the Honourable Tribunal for the following reliefs:
A declaration that the 2006 Census Final Results for Uvwie Local Government Area of Delta State of Nigeria do not represent any realistic account of the actual population of Uvwie Local Government Area;
An Order directing/compelling the respondent to conduct fresh census including demarcation of enumeration areas of the Uvwie Local Government Area in order to ascertain the actual population of the Area.
The Complainants called five witnesses in prove of their case while the respondents called only one witness
At the end of the hearing, today the Tribunal gave judgment in favour of the Complainants and ordered as follows:
The Tribunal declared that the 2006 Census Final Results for Uvwie Local Government Area of Delta State of Nigeria do not represent any realistic account of the actual population of Uvwie Local Government Area.
The Tribunal therefore made order, directing/compelling the respondent to conduct fresh census including demarcation of enumeration areas of the Uvwie Local Government Area in order to ascertain the actual population of the Area.
