A Federal High Court sitting in Port Harcourt has struck out a suit filed by the Rivers State Government against the Nigerian Civil Aviation Authority (NCAA) seeking the release of its bombardier BD700 – 1A11 aircraft grounded by the NCAA over alleged violations of its regulation by the operator of the aircraft.
The striking out followed the application of counsel to the Rivers State Government Mr. O.A. Dare to discontinue the action against the NCAA upon being served with a notice of preliminary objection by counsel for NCAA Dr. Alex Izinyon, SAN.
The court awarded cost of N25, 000.00 (twenty five thousand naira) in favour of NCAA.
It will be recalled that the Rivers State Government had gone to court over following NCAA’s grounding of a private jet conveying the Rivers Governor over violation of NCAA Regulations.
