Court Adjourns Suit Against Nyako Over $24 Million Islamic Bank Loan

Murtala-Nyako_trends.com_.ng 600Thousands of Adamawa state indigenes today stormed the old High Court premises where Justice Hafsat Abdulrahman of court 8 ,is presiding over the suit filed by Engineer Albert Stephen,Dr.Penni Boga and Dr.Francis Zira against Governor Murtala Nyako ,The Adamawa state government and the Adamawa State House Of Assembly is being heard. The action intends to stop the state government from accessing a 24 million United States Dollar loan from the Islamic Development Bank.The plantiffs are asking the court to declare the decision as unwarranted ,unreasonable and unconstitutional considering the high financial indebtedness of the state.

The indigenes came to lend their support to the action .As early as 7.30am the premises of the High Court was filled to capacity by people from all works of life. When the case was mentioned ,F.D.Kozah esq appeared for the plantiffs,while Konleganyiga U.J.esq appeared for the Adamawa State Government,Governor Murtala Nyako and the Attorney General And Commissioner For Justice,while Abubakar Sa’ad Esq Appeared For The State House Of Assembly.

Kozah informed the court that the matter is for mention and that the defendants have
filed their memorandum of appearance,but had not filed their statement of defence.
He further informed the court that they are still within time to file their statement of defence and other processes required by the rules of court.He added that in that circumstance ,the court should adjourn the case to a suitable date to enable the defendants file their statement ,if any.
The defendants conceded and accordingly Justice Hafsat Abdulrahman adjourned the
case to 9th December for mention.The judge based the long adjournment on the need for her to travel abroad for medical attention.
According to Barrister Kozah ,the position of the law is that once a suit is pending ,parties should maintain the status quo and are expected to refrain from doing anything that will foist res.
