Alleged DSO payment fraud: ‘Errors’ force Judge to strike out charge against NBC DG, others

#TrackNigeria -The Federal High Court, Abuja has struck out a charge dated January 21, 2019 filed by the ICPC against Director General of the National Broadcasting Commission, Malam Ishaq Modibbo Kawu, Managing Director of Pinnacle Communications Limited, Dipo Onifade, Chairman, Pinnacle Communications Limited, Sir Lucky  Omoluwa and Pinnacle Communications Limited.

The charge was struck out Tuesday  by presiding judge, Justice Folashade Ogunbanjo after  application to withdraw it by prosecution counsel, Henry Emore due to “some errors” contained in the charge.

Emore said he was replacing the charge with a second charge dated February 21, 2019 which the judge allowed when counsel representing Onifade, Omoluwa and Pinnacle Communications Limited, Alex Izinyon, did not oppose the application to substitute the charge.

The court also granted an order of substituted service against the first defendant, Malam Ishaq Modibbo Kawu, DG NBC which should be pasted on his last known address.

Before adjourning the case till March 12, 2019, the judge approved that Alex Izinyon accept the charge sheet on behalf of Onifade and Omoluwa while prosecution counsel should effect service of the charge on them within 48 hours.

The ICPC filed the charges alleging fraud amounting to N 2.5 billion in the payment for the Digital Switch Over (DSO)project.
